Buying property in the U.S. has been complicated since August 2024 with the introduction of a mandatory buyer representation agreement. Due to a recent NAR settlement, Buyer agreements are now a required document prior to any showings when purchasing real estate with an agent. What is a Buyer’s Representation Agreement?
Buyer representation agreements aren’t new…they’ve been
around…but now they are mandatory. Traditionally, our approach has always been
to show our value by our actions for our buyers. We simply didn’t feel they were required. But now they are. Prior to any showings, you will know how much
we charge for us to represent you and how we will be paid – and this can be for
a specific property or general in nature.

We write our contracts specific to each buyer…it could be for
a specific property or Island wide. We make
them fairly short – usually just a month or so – so that it’s not too long of a
commitment. If you are happy with our
service (most likely), you’ll ask to renew the contract. Or, you might choose another agent or perhaps
it’s not the right time for Island life for you. Our goal is to earn your trust every step of
the way.

What Happens When a Seller Isn’t Paying a Buyer Agent Commission?
When we agree on a commission in the buyer’s representation
agreement—let’s say 3%—we’ll negotiate with the seller to cover this cost in
the purchase contract. If the seller
only offers a 2% commission, we’ll negotiate to make sure it’s a win-win for
everyone.
